December 2, 2003 - For the Record response to: “Victim hopes for peace in sex abuse arbitration,” in the Boston Herald, 2 December, 2003 by Robin Washington, p.5.In the story it is stated: “Though the church has steadfastly denied the Foster allegations, Archbishop Sean O'Malley agreed to extend the settlement offer on the Cummings claim and allow Edwards to tell the arbitrator about the Foster charges.” The offer of an arbitration settlement to Mr. Edwards is connected solely with his claim against Fr. Cummings and has nothing to do with his original claim against Msgr. Foster. That claim was investigated twice by the Archdiocese and was found to be without substance. In addition, Archbishop O’Malley never agreed to allow Edwards to tell the arbitrator about the Foster charges. Mr. Edwards and his attorney informed counsel for the archdiocese that they were going to bring the Foster charges up within the arbitration. There is nothing within the arbitration process to stop them from doing so, even though it was not germane to the case that was being arbitrated, the allegation against Fr. Cummings. They chose to do so. There was no encouragement or permission from the archbishop. |
