April 26, 2003 - Inaccuracies in Boston Herald article "Bishop: Talks are still `active' in clergy sexual abuse cases"In a April 26, 2003 article in the Boston Herald, p.12, entitled, “Bishop: Talks are still `active' in clergy sexual abuse cases,” attorney Mitchell Garabedian, is quoted as saying, “There's a `stand down period,' yet the archdiocese is intensely active in trying to get these cases thrown out of court.” This is inaccurate. First, Mr. Garabedian represents 100 clients who have not agreed to the settlement talks and has pressed ahead with his clients' civil suits. Because he and his clients are not involved in the settlement talks, the stand down does not apply to them or their cases. In the stand down, both the plaintiffs and the defendants have agreed to suspend litigation. Mr. Garabedian has not. Therefore, in his case, lawyers for the Archdiocese and other defendants must respond in kind. Secondly, lawyers for the Archdiocese and the other defendants have made no determination as to an appeal of the first amendment defense. As such, Mr. Garabedian is in error if he argues that the Church is violating the stand down agreement in pursuing the first amendment defense since they are not in fact doing so. |
